Utah Pay Card Compliance

Besides being a service-based business, we are compelled to uphold the state-imposed mandates governing their use.

As we do each month, we take several of the requirement categories and compare the legal requirements governing them and insight into how rapid! PayCard® complies.

Our online, interactive map offers a state-by-state update on legal requirements. Here’s a look at the current payroll requirements in Utah; a state in which paperless pay is permitted:

  1. Employer Costs and Incentives

Legal Requirements:

No provision expressly addressing employer costs or incentives. However, an employee may not be required to refund or rebate any part of the employee’s wages except in accordance with the rules regarding wage deductions.

Utah Code § 34-28-3(6).

rapid! PayCard Program:

rapid! PayCard does not offer cash incentives to employers, or pass employer costs onto their employees.

  1. Cash Access

Legal Requirements:

With one transaction, the employee must be able to withdraw the full amount of his/her wages without incurring a fee, and the full amount of the employee’s wages must be available through the card on payday.

Utah Admin. Rule 610-3-22(B).

rapid! PayCard Program:

The rapid! PayCard provides numerous ways for employees to access their full net pay each pay period, including:

  • Over the counter bank teller transactions at banks displaying the logo of the applicable payment brand (Visa or MasterCard)
  • Electronic transfer to a bank account
  • US Post Office Money Order
  • ChekToday1 convenience checks

Additional methods of cash access include:

  • ATM withdrawals at Allpoint ATM and MoneyPass ATM surcharge-free network
  • Cash back with POS purchases using a PIN

When the employee uses one the transactions listed above as first transaction on pay period, it has not cost.

  1. Ability to Change Payment Method

Legal Requirements:

No express requirement relating to allowing employees to change the manner in which they receive their pay.

rapid! PayCard Program:

An employer that offers the rapid! PayCard should allow its employees to switch to direct deposit or another payment method offered by the employer upon reasonable notice.

  1. Transaction Histories

Legal Requirements:

No express requirements relating to transaction histories on pay cards.

rapid! PayCard Program:

rapid! PayCard makes transaction information available to cardholders online, via the rapid!Access2 mobile application and over the telephone2. Transaction data can be printed from the cardholder website or upon request, rapid! PayCard will provide a written transaction history.

  1. Convenience Checks

Legal Requirements:

The Utah wage payment statutes and regulations do not expressly address convenience checks.

All paychecks must be negotiable and payable in cash on demand, without discount at a depository institution. The name and address of the depository institution must appear on the instrument.

rapid! PayCard Program:

rapid! PayCard offers ChekToday which may be cashed by cardholders at participating Walmart stores at no cost, check cashing facilities or used to make other direct payments.

At rapid! PayCard, we not only stringently observe state-specific compliance, we offer the flexibility both employers and employees need to facilitate the payroll process itself.
